I'd believe what he says about working on a new movie and that his techs screwed it up. I doubt he has ever even poured any of the copies that he has sold on eBay. The sad part about this is that you had to file a dispute against him to get his attention. Nothing like an e-mail from paypal saying that your account is locked and you can't send or recieve payment. It total bull$hit what he is saying about his account though. Surely his shop can pour another casting, send it to you and then you could relinguish the dispute. The decision is up to you. Hopefully he does the right thing. Wish you the best of luck. If you have already filed the paypal claim, DO NOT dismiss the claim until you are satisfied with the situation you are in. If you dismiss before you get this resolved, you have forfeited your paypal protection, becasue you can NOT file another dispute over the same transaction. It is common practice for the person filed against to come back with an immediate e-mail with all kinds of excuses as to why they did not respond sooner. I have always found it very amusing that they have no problem at all responding once a claim is filed. That clearly shows they are in fact monitoring their e-mails. I have heard all the best excuses in the world, and they are all pretty much the same. I do believe a resolution should be sought prior to filing a complaint, but if you were left with no communication or answers, then you certainly should have filed. Keep the dispute open until the matter is resolved. Keep your eye on the prize ... you want what you paid for, in the condition it was represented as being in. If the guy is on the up and up, he will get it solved for you, and then you can close the dispute. The line of, "Please close the dispute so I can have the funds to complete your order" is a line I have heard many times. Don't buy it. This is NOT your problem, it is HIS! For the sake of being fair, I do not know this guy or anything about his business practices. He may be totally legit in everything he is saying. But don't make that assumption. Hold him to the business end of this transaction. This is the only way to combat dishonest dealers. Not saying he is one ... but again ... Caveat Emptor! So now he wants me to send the mask back and he will issue the refund but he has yet to reply to the paypal dispute. Currently paypal is awaiting his response (it has been for over a week), and his deadline to respond is July 22. You would think he would know how this works, why send me emails outside the paypal dispute to try to resolve it? I will update here when I get something worked out. I wouldn't budge on that paypal complaint until you've returned the mask and received it repaired, or received a new one.If his people aren't able to do the task, he needs to get better people. Hopefully he learns a lesson from this and no one else get's any more of those craptacular hockey masks that don't match the picture.I'm not saying he isn't an honest business man, just saying his current methods leave a bit to be desired. The complaint is there because he or his people dropped the ball, sent you garbage, and then completely ignored you. I do however totally agree that you should not remove the dispute. It's his problem, not yours. I think that if he doesn't respond in a timely manner---you win the dispute. Good luck |
