Unless you can proof the government otherwise chances are you have to pay and personally I wouldn't fool around in regards to this issue as there might be heavy fines etc. associated with evading these taxes. Secondly if your ex-wife used your ebay account unbeknownst to you and without your consent I would talk to my lawyer about that as well since that is a criminal offense.
