Need Advice On Possible Bum Deal! - Dzsturbed - 08-17-2007 I need some serious advice on what steps you all would do on a possible deal through ebay that is going down the drain. I bought screen used wardrobe (a hero outfit) and after making payment about a week ago and i was told it would be sent out on Monday. I just got a message today that the seller is sending out a refund to me today because her husband argued with her about selling it. Now i know I got a good deal and the outift is worth at least 2 1/2 times more than what i paid for it. That's what I think the REAL problem is. They wanted more for it and they didn't get it. I've dealt with the person before with no problems and now this. I replied to her message stating that I don't want a refund, I want what I paid for. I also told her that I will not accept the money order and will send it back with signature confirmation. I'm waiting to hear back from her. I contacted a highly reputable collector and was told if she's doesn't comply with your first warning then to file a 'non-seller' performance against her on Ebay. After that and if no resolution happens I was told to let her know that she's doing bad business and to let her know that I will have to let everyone know in the prop/wardrobe collectiing community how she does business.Do you all think those a re good steps to take? Odds are the seller is not going to sell you the item no matter what you do. There’s only one real reason for the seller not to ship the item to you, and that is because he probably doesn't have it to ship. If the seller wanted more money for it he could have put a reserve or started the bidding at the price he wanted. In a situation like this you may be better off taking the refund and issuing a negative. If the seller sends you a refund, don’t mail it back, the seller can refuse to sign for it and it’ll just be sent back to you. And also the seller can say “Hey I never received anything from this guy” and poof, there goes your money.If the item is worth the fight, then I do have a few suggestions. If they send you a refund in the mail don’t send it back to them, hold on to it, don’t cash it or deposited it, if you do the seller can argue that you agreed to a refund. Issue a negative FB and report the seller to ebay, let the seller know you will do this and if necessary you will take them to court. Unless the item is worth thousands of dollars the seller will say F’it and ship you the item to avoid any problems. However the seller can just claim he sent you the item when he didn’t, item doesn’t show up, “Oh, must have gotten lost in the mail, let me issue you a refund”. I know the person does have the item in hand. This person has been a collector for a while and I know alot of the small inventory they have. I do believe the excuse that her husband argued with her for selling it and told her to refund me. I got it for a good price and they both know that and they both know they could've made at least $300 if not more on it. That's not my problem, that's theirs. The item isn't worth thousands but it is something that I wanted. So no matter if it was 5 bucks, if I paid for it, I want it. Sometimes you have to settle for a refund but I hope it doesn't come to that. Collectors know who she is and MM con goers know who she is. If she wants to ruin her name throughout the community, so be it. I am going to wait for her reply and give her the chance. She might have a change of heart and do what's right. I want to warn everyone about doing business with this person. I will not post her personal info but her Ebay ID is hgirl01. Here is her reply to me filing a complaint with ebay..."I just responded to the dispute email and checked the box that says I want to offer the buyer a full refund. As you can see, that is clearly an option for me that ebay is allowing. You really need to just let this go. There is no way I am sending it to you. NO WAY. NO WAY. NO WAY. Like I said this is MY , did you get that, MY outfit. YOUR money is being returned. It happens everyday on ebay. I am sorry you want it but oh well. I don't see where we have anymore to discuss and I WONT BE answering anymore of your emails."Well that's that I guess. Hopefully I get my refund soon. |
