A copyright does not have to be registered for it to be effective. Te law was changed in the 70s (if I remember correctly) to protect those all works of art, etc that were created thereafter. Althought it certainly helps to file for a copyright, you still have rights to the work you produce no matter what....even though it's harder to prove. But if Colin has an original, well, that pretty much seals the deal. The short answer is, yes, the image is protected under the the rights of it's creator and the person selling it on eBay is doing so wrongfully.
