    I need to file a claim against an ebay seller who has yet to send me the items I won in the auction. I won the auction on the 11th, and have yet to hear ANYTHING at all from him period. I filed a dispute through paypal, but do I have to wait until that is over with to file a claim? I just dont want to be f*cked out of the money I sent before he gets it out of his account.Any info is appreciated.

    <b>you can escalate the claim to a dispute anytime I believe. Youc an even call paypal and make sure theyre on top of it. I dealt with one this year and they fixed the situation in about a week or so.</b>

    Thats what Im asking. Im just trying to find out what I have to do to file a claim rather than a dispute. I filed the dispute days ago and he still isnt responding. I need to get my money out of his account before he tries to run with it. (if he hasnt already)

    Hey Puck, you have 45 days from the payment to file a claim and then 20 days from the claim to escalate it. I would escalate it right away. The entire process takes weeks and could still end without your money back even if you win the dispute. You can cancel or close a dispute anytime if the transaction is resolved and you can even reverse it after it has been decided in your favor.Hope that helps. J

    Hey! If you paid through PP with your credit card... just call your cc company and get them to reversed the charge... just tell them you havent rec'd it... the buyer is getting back to you etc... they will reverse the charge from Pay Pal and then that money then is debited to the seller's account.... thats what I did with a certain tool from this board when I didnt recv. what I paid for....Cheers,Steven

    I dunno if thats true... Ive won a couple dispute... and Pay Pal stated eventhough they've decided in my favor, they cannot return my money... due to the seller not having any balance in their account."Like I said if you paid with a credit card through pay pal... just dispute the charge...Good luck!Cheers,Steven

    If the seller has $0 in his account you get NOTHING.
